can you save a pattern from a selection in CS4

I have been watching tutorials and in PSE you can make a pattern from a selection. I tried to do this in CS4 and the define pattern was disabled. I made a separate document to make the pattern but I would love to do it as a selection.

If someone knows the trick please give me a yell.

I have CS3 - but I'm guessing that Define Pattern is still under Edit and you just couldn't click it when you wanted to? That happens to me all the time because I've done something like have an invisible layer active, or have a path instead of a layer highlighted, or some crazy thing - I've always got to click around and figure out what I've done wrong. Maybe that'll help :)
