Hi, Sweeties!!!
I see we are as chatty as usual! I'm also enjoying the new smilies! Where are you finding them???
I've lurked and (as often as I can) followed the links and enjoyed the chuckles and thought good thoughts and provided prayers for our hurting. In other words, WOS and WVS and WEES!!
Oh, and I had to go back to work!! I enjoyed my 2 weeks at-home vacation but it was time to go back today. So I won't be able to lurk as much but I'll still be giving those good thoughts and prayers.

Since there have only been a few cases to date, mostly in lower judicial instances, there is no guiding case law on this issue. Experts in the United States believe that sometimes, such use of an unsecured wireless network may be considered an "unauthorized access of a computer" which is prohibited under Federal law and even theft of communications. Legal causes of action which were cited include defrauding the Internet service provider and a breach of the Internet service agreement.
Alternatively, such actions may be deemed trespass to chattel. In addition, under certain circumstances, including a massive use of the network in a manner which effectively prevents its operation for the owner, it may be deemed as the unauthorized performance of a telecommunications operation (the unauthorized operation of the router for the purpose of granting access to the Internet), harassment using a telecommunication device or the disruption of the conveyance of a telecommunications signal, under the Communications Law (Telecommunications and Broadcasting). The breach of such section is punishable by fines and prison sentences. Theoretically, this is similar to the unauthorized connection into cable television broadcasts or the neighbor's phone line and the causes of action cited in lawsuits in such cases would apply.
However, theory aside, in effect, in most cases it would be difficult to prove and quantify the damage caused due to the usage of the wireless network. It would also difficult to prove the mens rea, purpose, required in the said offenses. This is because in many cases the connection to the wireless network is carried out automatically by the computer and the user only discovers this after a while, if at all.

Omi - my direct experience was when a neighbor hacked in on my satellite signal a couple of years ago. I discovered it rather quickly since if I exceed my allotment of bandwidth during a 24-hour period, I have no connection and have to wait for a "rebuild" period. Since I knew I wasn't downloading or uploading enough to exceed my limits, the satellite company sent a tech who quickly discovered my neighbor using my signal. He did install some security features that made it impossible for my neighbor to steal my signal. About a week later, I received a copy of a letter the satellite company mailed my neighbor citing several FCC violations that included theft which is punishable by stiff fines and penalties. I was also cited for not having the proper safeguards in place that allowed the hacker! Lessons sometimes learned the hard way!!

Kasha - I had no idea it was illegal or would cause someone else problems like that  It's just a network that's always available and said open to all users. I obviously misinterruped that. Thanks so much for letting me know!!!

Congrats on your DD getting A's & B's...that is wonderful!!!! :clap: :clap: What grade is she in? Must be one of the early grades if she's a Brownie scout.
I know how the Head Start goes b/c I had my grandson in HStart last year. And they certainly want all the physicals & shot records up to date. It's hard to keep up with so many kids and you have way more than I do! My 3 are our grandkids though and they're a handful and a half & more with that teenager!
That's really nice that your hubbie will help you like that. Mine doesn't know anything about this sbn'g and he doesn't want to know I don't think!
Can't wait to see your LO... will check it when I come across it. LOL you might have already posted it but I'm behind, as usual!

Granted, yes, we are a bit late on getting it done, but the Director knew we had been having insurance issues to begin with (over charging and not covering things that they should have been), and I had submitted proof to that. But now they've given me until Wednesday. I understand that rules are rules, so I called and begged the Pediatrics office to squeeze him in. We'll see how it goes.
Speaking of layouts, I finished one over the weekend for Kim's Digital De*Lights challenge this week. The cool thing is that HUBBY actually HELPED me! I had hit a 'scrapping block' on how I wanted it to look, so he came and sat next to me here at the ol' laptop and perused through my kits and supplies until he found a few things for me to try. He gave A LOT of input on this, and it brings a tear to my eye to think he might actually be starting to 'get it'. Of course, it could also be because of who the layout was about, because he loved her as his own. (you'll see what I mean when I get it uploaded tonight AFTER I get caught up on all the OTHER layouts I'm behind on from trying to keep up with YOU!  )
